Christopher Pennington Legal 225 (MWF 11:00- 11:50) 2/1/17 Chatper 1 Case Question 1; P. 18 You be the Judge Chapter 1 Case Question 1 If a civil case was brought to the court regarding Bob burglarizing Vince's house, the state may prosecute Bob solely of the crime. Vince can also file a civil lawsuit in regards to suing Bob for negligence and for destroying his possessions, seeking money. In this instance criminal and civil law are joined together. If a criminal case was brought to the court regarding Bob burglarizing Vince's house, it would be prosecuted by the government who pays a district attorney to bring it to the courts. A criminal case is solely in the governments hands and not Vince's. In a criminal case if the jury was to believe that Bob was guilty of burglarizing Vince's house, he would be subject to a punishment of a prison sentence, fine, or both. If fined the money goes to the state, not the opposing party. P. 18 You be the Judge I believe that the Plaintiff Soldano is not justifiable in regards to filing a civil suit against the defendant, the owner at the Circle Inn. I say this because the fight did not break out on the Circle Inn's property, the property also happens to be private. This leaves the plaintiff out of favor because the fight was not held there and the bartender from the Circle Inn was working in his private area, which gave him no accessible liability to anything happening across the street. I would personally rule in favor for the plaintiff against the defendant's argument.

How to Make APA Ins APA style is the format that is typically required of students who areà writing essays and reportsà for courses in psychology and the social sciences. This styleà is similar to MLA, but there are small but important differences. For example,à the APA format calls for fewer abbreviations in the citations, butà it places more emphasis on publicationà dates in the notations.à The author and date are stated any time you use information from an outside source. You place these in parenthesesà immediately after the cited material, unless you have mentioned the authors name in your text. If the author is stated in the flow of your essay text,à the date is parenthetically stated immediately after the cited material. For example: During the outbreak, the doctors thought the psychological symptoms were unrelated (Juarez, 1993). If the author is named in the text, only put the date in parenthesis. For example: Juarez (1993) has analyzed many reports written by psychologists directly involved in the studies. When citing a work with two authors, you should cite the last names of both authors. Use an ampersand () to separate the names in the citation, but use the word and in the text. For example: The small tribes along the Amazon that have survived over the centuries have evolved in parallel ways (Hanes Roberts, 1978). or Hanes and Roberts (1978) claim that the ways in which the small Amazonian tribes have evolved over the centuries are similar to each other. Sometimes you will have to cite a work with three to five authors, if so, cite them all in the first reference. Then, in following citations, state only the first authors name followed by et al. For example: Living on the road for weeks at a time has been linked to many negative emotional, psychological, and physical health issues (Hans, Ludwig, Martin, Varner, 1999). and then: According to Hans et al. (1999), lack of stability is a major factor. If you use a text that has six or more authors, cite the last name of the first author followed by et al. and the year of publication. The complete list of authors should be included in the works cited list at the end of the paper. For example: As Carnes et al. (2002) have noted, the immediate bond between a newborn baby and its mother has been extensively studied by many disciplines. If you are citing a corporate author, you should state the full name in each in-text reference followed by the publication date. If the name is long and the abbreviated version is recognizable, it may be abbreviated in subsequent references. For example: New statistics show that owning pets improves emotional health (United Pet Lovers Association [UPLA], 2007). The type of pet seems to make little difference (UPLA, 2007). If you need to cite more than one work by the same author published in the same year, differentiate between them in the parenthetical citations by putting them in alphabetical order in the reference list and assigning each work with a lower case letter. For example: Kevin Walkers Ants and the Plants They Love would be Walker, 1978a, while his Beetle Bonanza would be Walker, 1978b. If you have material written by authors with the same last name, use the first initial of each author in every citation to distinguish them. For example: K. Smith (1932) wrote the first study done in his state. Material obtained from sources such as letters, personal interviews, phone calls, etc. should be stated in the text using the persons name, the identification personal communication and the date said communication was obtained or took place. For example: Criag Jackson, Director of Passion Fashion, stated that the color changing dresses are the wave of the future (personal communication, April 17, 2009). Keep in mind a few punctuation rules as well: Always put the citation at the end of the material used.If you are using a direct quote, put the citation on the outside of the closing quotation mark.End punctuation (period, exclamation point) for the text follows the parenthetical citation.If you are using a block quotation, place the citation after the final punctuation mark of the paragraph.Always include a page reference for the material being cited.

Speech on Happiness :: Happiness Essays
Today I am here to discuss a topic with you but I donââ¬â¢t know where to start. If I ask you, "Is Money a Prerequisite for Happiness?", how would you answer? Your answer should be NO. Definitely NO. But is this truly what you believe? Is this consistent with how you act? All of us want to make money to gain some status, some comfort and some luxurious. This money has brought; is bringing; and will bring so many differences between some of you and me. These differences will be later named as differences between the rich and the poor. If I ask you ââ¬ËDo you know what is happiness? You would thrillingly and pleasingly answer me YES, OF Course Then lets share some examples of the happiest man. One would experience happiness when a leads a luxurious life. One may also experience happiness when he had expanded his business almost across the globe. One may also experience happiness when he had his meal in the most famous and expensive hotel. One may also experience happiness when he attends honorable parties. One canââ¬â¢t imagine an ideal life like this. But donââ¬â¢t you feel I have missed out something in the above examples ââ¬â yes, I have thereby missed out the actual meaning of happiness. No one can tell which philosopher in his writings has mentioned money to be as happiness. Which dictionary ever explains money to be a synonym of happiness? Which mathematician has ever given up a formula - LIFE + MONEY = HAPPINESS. None of the scientists ever brought up a formula ââ¬â Money when given up at 100 degree Celsius gives you (Happiness)2 When none of us has ever come across such words and formulas, none of the great personalities has ever mentioned it, then who the hell has instilled it in our minds that money brings happiness. But among this debate one question still raises its head - What is happiness? Happiness is not actually leading a luxurious life but the luxury of living a life. Happiness is not actually about expanding your business, but it lies in expanding the horizons of life. Happiness is not having a meal in the most famous restaurant but to have it with your most beloved family. It does not lie in attending honorable parties but to attend a party with honor. Happiness is to wear a smile when it feels like crying.

A stakeholder is a person, group, or organization that has a direct or indirect stake in an organization because it can be affected by the organizationââ¬â¢s actions, objectives, and policies. In a business, there are many people and organizations who are able to support and have responsibility to keep the business survive. Stakeholders are one of them. They are people who have an interest in the activities of a firm or business, however, they do not have to own any finance in that business. There are two types of stakeholders ââ¬âInternal and External stakeholders.The external stakeholders in construction project are: Local, and National authorities and government, Social organizations, Political organization, Local communities, the General public, Environmentalists, Interests groups, Real estate owners, Nearby residents, Trade and industry, Social Services (schools, Hospitals etc. ), Media, anyone else who believes he or she has a stake in the project. Internal stakeholders are: Project owners, Client organization, Project Management team, Customer user, Suppliers contractorsââ¬â¢ subcontractors, Employee, Financiers, and Creditors.Major stakeholders for the big dig project are: the Massachusetts Highway Department, the Massachusetts Turnpike Authority (MTA), the Metropolitan Highway System (MHS), Bechtel/Parsons Brinckerhoff (B/PB), and the General public. The main direct stakeholders who are benefiting from the completion of the project are the Boston commuters. The main objective of the Big Dig project is relieving highway traffic congestion, reducing traffic jams in Downtown Boston, and decreasing the accident rate. The elevated Central Artery had been designed to carry up to 75,000 vehicles per day when it opened in 1959.However, the size of traffic continued to increase, with traffic mounting to 200,000 vehicles per day, and approximately 190,000 of those going over the Charles River crossing in the 1990s. The two tunnels under Boston Harbor b etween downtown Boston and East Boston/Logan Airport were facing the same problem. The accidents were concentrated around exits from the elevated highway onto local streets in downtown Boston, and this was linked to the lack of an ââ¬ËInner Beltââ¬â¢ highway that was supposed to complete the Central Artery design.Such an Inner Belt was never built because of community opposition to the construction of an additional highway, which would have required displacing thousands of residents and businesses. Through the years, it became clear that without major improvements to the Central Artery and the harbor crossings, the congestion was only going to get worse. The annual costs from this congestion were significant, including wasted fuel from idling due to still traffic and related deficiencies to air quality, as well as charges for delayed deliveries.All of these were estimated to cost $500 million per year. In addition, Boston's North End and Waterfront neighborhoods were cut off f rom the downtown, limiting these areas' ability to participate in the city's economic life. The success factors are the contributions made by the management towards a successful project. These can be classified into five groups as follows: â⬠¢The project manager: Having a project manager is not going to guarantee the success of a project. The person needs to have an array of skills under his arm to use during the project.He must guide the rest of the team to successfully complete all the objectives. â⬠¢The project team: Project managers are very lucky if they have the option to choose their project team. More often, their team is inherited to the project from various sectors of the organization. The team needs to consist of variety of skills and experience. Collectively as a team, success is easy to achieve with proper guidance. All members of the project team must be committed to the success of the project and the overall mission of the company. Project: The scope and timel ine of the project are crucial. For example, if a project is urgent, the critical factor in that case is time. â⬠¢The organization: Top management support is the principal success factor for many independent research groups. The organization needs to provide support to both the project manager and the project team. â⬠¢External environment: External environment can be the political, economic, socio-culture and technological context in which the project is executed.Factors like the weather, work accidents or the governmentââ¬â¢s favorable or unfavorable legislation can affect the project in all of its phases. External constraints should not affect the project. Back up plans need to be in place in case daily tasks cannot be carried by the team. Yes, the project is successful. The economic impacts of the projects are as follows: â⬠¢There has been approximately 62% improvement in the traffic flow, which exceeded project expectations. â⬠¢A 12 percent reduction in citywi de carbon monoxide levels was achieved. Improvements and substantial reductions in traffic delay is providing approximately $168 million annually in time and cost-saving for travelers. â⬠¢Average travel times from the I-90/I-93 interchange to Logan Airport during peak periods have decreased between 42% and 74%, depending on direction and time of day. â⬠¢Average afternoon peak hour northbound travel time on I-93 through downtown has dropped from 19. 5 minutes to 2. 8 minutes. â⬠¢The opening of the I-90 connector to Logan International Airport has added 800,000 residents to the 1. million who can access the airport within a 40-minute drive of their home. Overall, the project is successful as can be seen from the above economic impacts of the project. The major objective to relief the traffic has been successful and there is a much better traffic flow now. This project gives us a good idea about the success criteria used here and gives us a practical example of the required contributions by the management and employees to make the project successful.
